SUBJECT: Re: Dishonour of Cheque No. 045892 dated 15.02.2025 for ₹75,000 drawn on HDFC Bank, Rohini Branch — Notice under Section 138 of the Negotiable Instruments Act, 1881

Under instructions from and on behalf of my client, Mr. Rajesh Kumar Sharma, residing at H.No. 42, Sector 15, Rohini, New Delhi — 110085, I hereby issue you this Statutory Notice under Section 138 of the Negotiable Instruments Act, 1881 as follows:

1. That my client had extended a friendly loan of Rs. 75,000/- (Rupees Seventy-Five Thousand Only) to you on 10.01.2025 as repayment of a prior debt, which transaction is duly evidenced by acknowledgment in writing.

2. That in discharge of the said legally enforceable debt, you issued Cheque No. 045892 dated 15.02.2025 for a sum of Rs. 75,000/- (Rupees Seventy-Five Thousand Only), drawn on HDFC Bank, Rohini Branch, New Delhi, in favour of my client.

3. That my client duly presented the aforesaid cheque for encashment through his banker on 18.02.2025. The said cheque was, however, returned unpaid vide bank memo dated 20.02.2025 with the remark "Insufficient Funds", thereby constituting an act of dishonour under Section 138 of the Negotiable Instruments Act, 1881.

4. That the dishonour of the said cheque constitutes a criminal offence punishable with imprisonment for a term which may extend to two years, or with fine which may extend to twice the amount of the cheque, or with both, under Section 138 of the Negotiable Instruments Act, 1881.

5. TAKE NOTICE that you are hereby called upon to pay the sum of Rs. 75,000/- (Rupees Seventy-Five Thousand Only) to my client within FIFTEEN (15) DAYS from the date of receipt of this notice. Failure to do so shall compel my client to initiate criminal proceedings against you under Section 138/142 of the Negotiable Instruments Act, 1881, and civil recovery proceedings before the appropriate court, entirely at your cost and risk.

6. That in the event of non-compliance with this notice, my client shall also be entitled to claim the cheque amount along with interest at 18% per annum from the date of dishonour, legal costs, and such compensation as the court may deem fit.

Issued without prejudice to all other rights and remedies available to my client under law.
